StoryToShop LLC · Spicewood, TX 78669 · dmca@storytoshop.ai
Incorporated into the StoryToShop Seller Agreement under Section 46. This Policy governs legal intellectual-property claims. StoryToShop's separate marketplace originality standard is handled under the Product Originality Policy and is a different process with a different standard.
1. Compliance with the Digital Millennium Copyright Act
StoryToShop LLC ("StoryToShop") respects the intellectual property rights of creators and copyright owners. In accordance with the Digital Millennium Copyright Act, 17 U.S.C. § 512 ("DMCA"), StoryToShop maintains an expedited procedure to process notices of alleged copyright infringement.
2. Designated DMCA Copyright Agent
Notices of claimed copyright infringement must be submitted to StoryToShop's Designated Agent:

3. Requirements for a DMCA Takedown Notice
To be effective under 17 U.S.C. § 512(c)(3), a notification of claimed infringement must be a written communication containing substantially the following:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the material claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, including the exact URL or storefront link on StoryToShop.
- Information reasonably sufficient to permit StoryToShop to contact the complaining party, including address, telephone number, and email address.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Notices that do not substantially comply with these requirements may not be actionable. StoryToShop may request additional information before acting.
4. What Happens After a Valid Notice
On receipt of a notice that substantially complies with Section 3, StoryToShop will act expeditiously to remove or disable access to the identified material, and will take reasonable steps to notify the affected Seller of the removal and of the counter-notification process described in Section 5.
5. Counter-Notification Procedure
If a Seller believes that material removed or disabled as a result of a DMCA notice is not infringing, or that the Seller has authorization from the copyright owner, the Seller may submit a written counter-notification to the Designated Agent containing:
- The Seller's physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed.
- A statement under penalty of perjury that the Seller has a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- The Seller's name, address, telephone number, and email address, together with a statement consenting to the jurisdiction of the Federal District Court for the judicial district in which the Seller's address is located, or, if the Seller's address is outside the United States, for any judicial district in which StoryToShop may be found, and a statement accepting service of process from the complaining party.
If StoryToShop receives a valid counter-notification, it may send a copy to the original complaining party and inform them that the removed material may be restored in ten (10) to fourteen (14) business days unless the copyright owner files an action seeking a court order to restrain the Seller from engaging in infringing activity relating to the material.
6. Repeat Infringer Policy
StoryToShop will terminate, in appropriate circumstances, the accounts of Sellers determined to be repeat infringers.
For this purpose, a repeat infringer is a Seller who has received two (2) or more final, un-countered DMCA takedown notices, or against whom there have been two or more judicial determinations of infringement.
A takedown is not counted toward this total where the Seller submits a valid counter-notification and the material is restored, or where StoryToShop determines the notice was invalid, mistaken, or abusive.
7. Abusive and Fraudulent Notices
Knowingly false, fraudulent, abusive, or retaliatory intellectual-property complaints may result in restriction or termination of the reporting party's StoryToShop account, in addition to any liability the reporting party may have under 17 U.S.C. § 512(f) or other applicable law.
8. Trademark and Trade Dress Claims
Trademark, trade dress, patent, and right-of-publicity claims are not governed by the DMCA and are not handled through the process in Sections 3 through 5.
Direct these claims to legal@storytoshop.ai with:
- Proof of trademark registration or the basis of the unregistered right claimed;
- The exact URL of the disputed listing or storefront;
- A clear explanation of the claimed consumer confusion or other basis of the claim; and
- Contact information for the rights holder or authorized agent.
9. Relationship to Creator Integrity Review
A complaint under this Policy asserts a legal right. A complaint under the Product Originality Policy asks StoryToShop to apply its marketplace standard, which may be stricter than what the law requires.
The two processes are separate. Filing one does not initiate the other, and a determination under one is not a determination under the other. A marketplace originality decision is never a finding that legal infringement occurred.
10. Service Targets
StoryToShop's general 72-hour human-review target for escalated marketplace complaints does not modify any statutory DMCA deadline or procedure.
